1. About These Terms
These Terms & Conditions (“Terms”) govern your access to and use of the MFRS Gaming website and related pages (collectively, the “Website”), and the services made available through the Website and MFRS Gaming’s official community channels (including our official Discord server) (collectively, the “Services”).
The Services may include skill-based video game tournaments, leaderboard challenges, and promotions (each, an “Event”). Each Event may have additional rules and disclosures (the “Official Rules”). The Official Rules for a specific Event are incorporated into these Terms by reference and, in the event of a conflict, control for that Event.
Please also review our Privacy Policy, which is incorporated into these Terms by reference.
2. Eligibility
The Services are intended for users located in the United States. Participation in certain Events may be limited by geographic region, state law, platform rules, and/or Official Rules. You are responsible for ensuring that participation is legal where you live.
2.1 Adults (18+)
If you are eighteen (18) years of age or older, you may register and participate in Events subject to these Terms and the applicable Official Rules.
2.2 Under 13
If you are younger than 13 years old, you may not access or use the Services.
2.3 Verification
We may request age verification, identity verification, residency verification, account/platform ownership verification, and/or tax documentation to confirm eligibility, prevent fraud, preserve competitive integrity, comply with law, and/or award prizes. Failure or refusal to provide requested verification may result in disqualification and/or forfeiture of prizes to the maximum extent permitted by law.
3. Accounts, Registration, and Security
Certain parts of the Services require registration or submission of information (such as username, email address, gamer tag, platform ID, and other details) to participate. You agree to provide current, complete, and accurate information and to keep it up to date.
- You will not provide false information or misrepresent your identity or affiliation.
- You will not create multiple accounts/registrations to gain a competitive advantage or bypass restrictions.
- You are responsible for all activity conducted under your registration identity, including activity in community areas.
- You are responsible for maintaining the confidentiality and security of your devices, platform accounts, and login credentials.
Notify us promptly if you suspect unauthorized use. We are not responsible for losses caused by unauthorized account access outside our reasonable control.
4. Tournaments, Promotions, and Official Rules
Each Event may have Official Rules that include scoring, format, brackets, match timing, check-in, reporting, tie-breakers, platform requirements, region settings, evidence requirements (such as screenshots, clips, or match logs), and prize details.
- Final Authority: MFRS Gaming decisions are final and binding on all matters related to Event administration, rule interpretation, and enforcement.
- Schedule & Logistics: Start times, match windows, formats, or requirements may be updated for operational or integrity reasons.
- Connectivity: Players are responsible for their own internet connection, hardware, and platform access unless Official Rules state otherwise.
5. Entry Fees, Purchases, and Payments
Browsing the Website is free. Some Events may require an entry fee, subscription, or purchase. Fees are assessed per Event (unless stated otherwise) and are processed through third-party payment providers. Available payment methods and processing times may vary.
5.1 Authorization and Accuracy
When you provide payment information, you represent that you are the authorized user of the payment method and that the information you provide is accurate.
5.2 Chargebacks, Disputes, and Fraud
Chargebacks, reversals, or disputes that we reasonably believe are abusive, fraudulent, or made without a valid legal basis may result in disqualification, forfeiture of prizes, suspension or bans, and other remedies available under law. You agree to reimburse us for reasonable costs incurred due to chargebacks or fraudulent disputes to the extent permitted by law.
5.3 Skill-Based Competition; No Gambling
Events are intended to be competitions of skill where outcomes are determined by player performance, as defined by the Official Rules. The Services may not be used for unlawful gambling, wagering, or betting on outcomes.
6. Prizes, Taxes, W-9, and Reporting
Prizes may include cash, hardware (including PCs), peripherals, gift cards, or other items. Prize details, approximate retail value (“ARV”), and substitution rules may be specified in the Official Rules.
6.1 Taxes Are the Winner’s Responsibility
To the maximum extent permitted by law, winners are solely responsible for all federal, state, and local taxes and reporting obligations associated with prizes or winnings (“Winnings”). MFRS Gaming does not provide tax advice.
6.2 W-9 and Identity Verification
Where required by law or for prize fulfillment, we may request a completed IRS Form W-9 (or other applicable tax form), identity verification, and/or proof of eligibility before awarding a prize. If required information is not provided within the timeframe stated in the Official Rules (or within a reasonable time if not stated), the winner may be disqualified and the prize may be forfeited or awarded to an alternate winner, to the maximum extent permitted by law.
6.3 1099 Reporting
If required by law, we may issue appropriate tax reporting forms (such as IRS Form 1099) to winners and file required copies with tax authorities. The value reported may include the ARV of non-cash prizes.
6.4 No Withholding; Backup Withholding
Unless required by law, prizes are awarded without withholding. If a winner fails to provide required tax information or provides incorrect information, we may be required to withhold a portion of the prize as “backup withholding” and remit it to the IRS, to the extent required by law.
7. Minors (Ages 13–17)
Minors who are at least 13 years old may be permitted to participate in certain Events only where lawful and only if the applicable Official Rules allow it.
7.1 Parent/Guardian Consent Required
For a Minor to participate, a parent or legal guardian (“Parent/Guardian”) must: (a) provide verifiable consent; (b) accept these Terms on their own behalf and on the Minor’s behalf; and (c) accept responsibility for the Minor’s participation and conduct.
7.2 Paid Entry by Minors
If a Minor is permitted to enter a paid-entry Event, the Parent/Guardian must complete payment and registration (or otherwise expressly authorize payment) and may be required to provide additional verification. We may restrict or prohibit Minor participation in paid-entry Events in certain states or Events as required by law or the Official Rules.
7.3 Minor Winners
If a Minor is a potential winner, we may require Parent/Guardian identity verification, signed affidavits/releases, and completed tax forms from the Parent/Guardian. Prizes may be awarded to the Parent/Guardian on the Minor’s behalf where permitted by law and consistent with the Official Rules.
8. Refund Policy
Entry fees are refundable up to 48 hours before the scheduled Event start time unless the Official Rules state otherwise. Refund requests must be emailed to support@mfrsgaming.net.
- No refunds for no-shows, disqualifications, late check-ins, or rule violations.
- If we cancel an Event, a full refund will be issued (unless prohibited by processor rules or law).
- Approved refunds may take 5–10 business days to appear, depending on payment processors.
- If an Event is rescheduled, we may offer a refund window or transfer option when feasible, subject to Official Rules and processor limitations.
9. Competitive Integrity and Conduct
To protect fair play and community safety, you agree not to engage in unfair, abusive, or disruptive behavior, including:
- Cheating, exploiting bugs/glitches, using unauthorized software, macros, devices, or modifying game behavior.
- Collusion, match-fixing, throwing, bribery, or attempts to influence outcomes unfairly.
- Smurfing, account sharing, or playing under another person’s identity.
- Harassment, hate speech, threats, stalking, or abusive behavior in-game, on the Website, or in Community Areas.
- Doxxing or sharing personal information of yourself or others without permission.
- Interfering with Events (including intentional disconnects without legitimate reason) or falsifying results/evidence.
10. Community Areas, Discord, and User Content
We may provide or use community spaces such as Discord channels, chats, or other interactive areas (“Community Areas”). Content you post or submit through the Services or Community Areas is “User Content.”
You are responsible for your User Content and your conduct. We do not endorse User Content and disclaim responsibility and liability arising from User Content to the maximum extent permitted by law. We may remove, restrict, or moderate User Content at any time in our sole discretion.
10.1 License to User Content
By posting, uploading, streaming, or transmitting User Content, you grant MFRS Gaming a royalty-free, perpetual, worldwide license to use, reproduce, display, distribute, modify, and create derivative works from your User Content for purposes of operating, promoting, and improving the Services, including Event administration, highlights, marketing, and archival, in any media now known or later developed.
10.2 Feedback
If you provide suggestions, feedback, or ideas, you grant MFRS Gaming the right to use them without restriction or compensation.
11. Content, Intellectual Property, and DMCA
The “Content” includes the Website and all materials it contains, such as text, graphics, designs, software, audio, video, logos, trade names, trade dress, domain names, and other intellectual property (excluding User Content).
Subject to your compliance with these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Services for personal, non-commercial use. All rights not expressly granted are reserved.
Game titles, publisher names, and trademarks are the property of their respective owners and are used for identification purposes only. MFRS Gaming is not endorsed by or affiliated with any game publisher unless explicitly stated in Official Rules.
11.1 Promotional Rights
By participating in an Event, you grant us permission to use your username/gamertag, results, and gameplay clips/footage for Event operation, integrity review, and promotion (unless Official Rules state otherwise).
11.2 DMCA / Copyright Complaints
If you believe Content on the Services infringes your copyright, send a notice to support@mfrsgaming.net with sufficient information to identify the work, the allegedly infringing material, and your contact details. We may remove or disable access to material as required by law.
12. Privacy, Communications, and Marketing
Our collection and use of personal information are described in our Privacy Policy. By using the Services, you consent to receive transactional communications (for example: confirmations, updates, rule changes, verification requests, and prize notifications).
12.1 Marketing
We may send marketing emails only where permitted by law and consistent with your choices (including opt-in/opt-out mechanisms). You can opt out of marketing emails at any time using the unsubscribe link (where provided) or by contacting support@mfrsgaming.net. Transactional/service messages may still be sent.
13. Prohibited Uses
You may not, and may not assist others to:
- Use bots, scraping, data mining, or automated extraction methods.
- Reverse engineer, decompile, or attempt to derive source code from any part of the Services.
- Use Content or data to train AI/ML models without our written permission.
- Circumvent, disable, or tamper with security or access controls.
- Attempt to compromise accounts, systems, or Event integrity.
- Engage in unlawful activity through the Services.
14. Third-Party Providers and Websites
The Services may link to or rely on third-party providers (including Discord, payment processors, streaming platforms, game publishers, and tournament tools). We do not control and are not responsible for third-party content, policies, practices, outages, or acts/omissions. Your use of third-party services is at your own risk and subject to their terms.
15. Enforcement; Suspension; Termination
We may investigate suspected violations and take actions we deem necessary to protect the Services, community, and integrity, including removing content, restricting access, disqualifying participants, withholding prizes pending investigation, and reporting unlawful activity where necessary.
16. Warranty Disclaimers; Service Availability
THE WEBSITE, SERVICES, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE ARE NOT RESPONSIBLE FOR PLATFORM OUTAGES, ISP ISSUES, DEVICE PERFORMANCE, OR THIRD-PARTY SERVICE INTERRUPTIONS.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MFRS GAMING AND ITS OWNER, OPERATORS, AND CONTRACTORS (COLLECTIVELY, “MFRS”) ARE NOT LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO AN EVENT SHALL NOT EXCEED (A) THE ENTRY FEE YOU PAID FOR THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) IF NO ENTRY FEE WAS PAID, ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
18. Indemnity
You agree to indemnify and hold harmless MFRS Gaming and its owner, operators, contractors, and affiliates from and against third-party claims, losses, expenses, damages, and costs (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of Official Rules, unlawful conduct, or infringement of third-party rights.
19. Binding Individual Arbitration; Class Action Waiver
19.1 Agreement to Arbitrate
“Dispute” means any dispute, claim, or controversy arising out of or relating to the Website, Services, Content, Events, Promotions, or these Terms, whether based in contract, statute, tort, or any other legal theory. You and MFRS agree to resolve Disputes exclusively through binding individual arbitration under the Federal Arbitration Act (“FAA”), rather than in court, except as provided below.
19.2 Small Claims Exception
Either party may bring an individual claim in small claims court if the claim qualifies and remains in that court.
19.3 Informal Resolution First
Before initiating arbitration, you must notify us by emailing support@mfrsgaming.net and allow at least sixty (60) days for good-faith informal resolution.
19.4 Class Action Waiver
YOU AND MFRS AGREE THAT ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
19.5 Arbitration Provider and Rules
Arbitration will be administered by the American Arbitration Association (“AAA”) or JAMS under applicable consumer arbitration rules, unless the parties agree otherwise. The arbitrator may award the same damages and relief as a court of competent jurisdiction, subject to these Terms.
19.6 Location
Unless required by applicable law, arbitration will take place in Utah, or may be conducted remotely (video/phone) where permitted by the provider.
19.7 Time Limit to Bring Claims
To the extent permitted by applicable law, any Dispute must be commenced within one (1) year after the events giving rise to the Dispute. If not commenced within that period, it is permanently barred.
19.8 Severability
If any portion of this arbitration section (other than the class action waiver) is found unenforceable, it will be severed and the remainder will remain in effect. If the class action waiver is found unenforceable in its entirety, this arbitration section may be unenforceable to the extent required by law.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. For Disputes not subject to arbitration or small claims, you agree to submit to the jurisdiction of courts located in Utah, unless applicable law requires otherwise.
21. General Legal
21.1 Entire Agreement
These Terms, together with applicable Official Rules and referenced policies, constitute the entire agreement between you and MFRS Gaming regarding the Services and supersede all prior or contemporaneous understandings.
21.2 Changes
We may update these Terms at any time. If you access or use the Services after changes are posted, you are deemed to have accepted the updated Terms.
21.3 Assignment
We may assign our rights and obligations under these Terms as permitted by law.
21.4 Severability
If any provision of these Terms is unlawful or unenforceable, the remaining provisions remain in effect.
21.5 No Waiver
Our failure to enforce any provision is not a waiver of that provision.
21.6 Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including outages, platform issues, acts of God, labor disputes, internet disruptions, or governmental actions.
21.7 Electronic Communications
You agree that communications and notices we provide electronically satisfy legal notice requirements where permitted by law.
